Uttarakhand’s Law for Damage Recovery

1. What is the purpose of the new Ordinance in Uttarakhand?

The Ordinance aims to recover the cost of damages to public property during riots and protests directly from those involved. It seeks to ensure accountability and deter future instances of unrest by imposing financial penalties on the perpetrators.

2. How will the cost of damages be assessed?

The government has established a special tribunal tasked with assessing the cost of damages incurred during riots and protests. This tribunal will determine the financial liability of those found guilty.

3. What are the financial penalties for those found guilty?

Individuals found guilty of causing damage to public property will be required to pay a fine of up to Rs.8 lakh in addition to the recovery of the damage cost. This fine is intended to cover riot control expenses and other related costs.

4. What additional costs will the rioters have to pay?

Apart from the damage recovery and fines, rioters will also be responsible for paying the treatment costs of those injured in the violence and the expenses incurred by police, administration, and other agencies for riot control during the incidents.

5. What triggered the implementation of this Ordinance?

The Ordinance was introduced following violence in Haldwani’s Banbhoolpura, which occurred after the demolition of an illegal madrasa and mazar built on government-owned land. The incident resulted in five deaths and numerous injuries, highlighting the need for stricter measures to prevent and address riot-related damages.

6. What is the government’s stance on riots and public unrest?

The government, as stated by Chief Minister Pushkar Singh Dhami, is committed to strictly curbing cases of riots and unrest. The introduction of this Ordinance reflects the government’s approach to ensuring that individuals disrupting the state’s peace will face significant consequences.

7. How does this Ordinance affect the general public?

For the general public, this Ordinance serves as a deterrent against participating in activities that could lead to damage to public property. It also reassures citizens that the government is taking steps to maintain law and order and hold accountable those who cause public disturbances.
