WHAT IS EUROPE'S AI CONVENTION?
Europe's AI convention, formally known as Framework Convention on Artificial Intelligence and Human Rights, Democracy, and Rule of Law, was adopted by Council of Europe (COE) on May 17, 2024. This convention aims to ensure AI activities align with human rights, democracy, and rule of law.
WHAT IS A FRAMEWORK CONVENTION?
Framework convention is a legally binding treaty that sets broad commitments and objectives. Specific targets and detailed rules are established later through protocols. This approach provides flexibility while encoding core principles.
SCOPE OF CONVENTION
Ensures AI activities are consistent with human rights, democracy, and rule of law.
Covers AI activities by public authorities or private actors on their behalf. It also addresses risks and impacts from private actors in conformity with convention’s objectives.
NATIONAL SECURITY CONCERNS
Exemptions: Broad exemptions exist for national security, research, development, and national defense. Military applications of AI are not covered, which is a pragmatic move due to lack of consensus on regulating such applications.
General Obligations: Protect human rights, integrity of democratic processes, and respect for rule of law. Disinformation and deep fakes are indirectly addressed.
WHY IS AI CONVENTION IMPORTANT?
Human Rights Protection: Asserts that existing human and fundamental rights must be protected during AI applications.
Government Obligations: Directs governments to install effective remedies and procedural safeguards.
Comprehensive Approach: Aims to mitigate risks from AI systems concerning human rights and democracy. Implementation challenges are expected due to the rapid pace of technological advancements outpacing policy.
